By accessing or using HitOrNot ("the Service") at hitornot.io, operated by District Digital ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
HitOrNot is a YouTube video performance estimation tool. The 0–100 prediction score is generated by our own calibrated machine-learning model, trained on hundreds of thousands of real YouTube videos and their actual outcomes. We separately use a third-party AI language model (Claude by Anthropic) to write the qualitative analysis text that accompanies your score and to perform vision-based review of your thumbnail — Claude does not generate the score itself. All outputs are estimates and opinions generated by automated systems — they are not guarantees, predictions of financial return, or professional advice of any kind. Do not make significant business or financial decisions based solely on these estimates.
Free tier: New accounts receive 10 free predictions per month with no credit card required. Connecting YouTube Studio grants 5 additional predictions per month as a bonus. Free predictions reset each month.
Pro subscription — Auto-Renewal Disclosure: The Pro plan includes 100 predictions per month and is billed at $15.00 USD per month. Your subscription will automatically renew each month and your payment method will be charged unless you cancel before the renewal date. You can view your renewal date and cancel at any time through the billing portal (accessible from the app header when signed in as a Pro member). Cancellation takes effect at the end of the current billing period — you retain access until then.
Refunds: Payments are generally non-refundable for partial billing periods. However, if you are located in the European Union or United Kingdom, you may be entitled to a 14-day cooling-off period for digital services under applicable consumer protection law. To request a refund under this right, contact us at info@districtdigital.co within 14 days of your initial purchase.
Price changes: We reserve the right to change subscription pricing with at least 14 days' advance notice to active subscribers via email. Continued use after the notice period constitutes acceptance of the new price.
You agree not to:
By connecting your YouTube account, you authorize HitOrNot to access your channel analytics via the YouTube API Services. This data is used solely to improve prediction accuracy for your account. We do not sell or share your YouTube data with third parties.
By connecting your YouTube account you also agree to the YouTube Terms of Service and Google Privacy Policy.
You can revoke access at any time via your Google Account permissions.
The Service's interface, branding, scoring methodology, calibrated machine-learning prediction model (including the trained model weights and the training corpus of real YouTube videos and outcomes), and original code are owned by District Digital. The 0–100 prediction score is generated by our own model, not by a third-party AI. We separately license Anthropic's Claude language model to produce the qualitative analysis text and vision-based thumbnail review that accompany the score; Claude is not used to generate the score itself and is not owned by District Digital. You retain full ownership of any content you submit to the Service (video ideas, titles, scripts, thumbnail images). By submitting content, you grant us a limited, non-exclusive license to process it for the purpose of delivering the Service to you, including transient processing of thumbnail images to generate the model's image-embedding feature and to send the image to Anthropic for vision-based analysis.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
Prediction scores and verdict band probabilities (e.g., "X% of similar predictions land in the top 25%") reflect aggregate historical performance of our calibrated model on a held-out evaluation set. They are directional guidance based on patterns across many videos, not a forecast for any individual upload, and should be treated as one input among many — not as the sole basis for content or business decisions. Predictions are inherently probabilistic; individual outcomes will vary.
To the maximum extent permitted by applicable law, District Digital and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to lost profits, lost data, or business losses.
Our total cumulative liability to you for any claim arising from the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) $10 USD.
Some jurisdictions do not allow limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
By you: You may stop using the Service and cancel your subscription at any time via the billing portal.
By us: We may suspend or terminate your account for violation of these Terms. If we terminate your account without cause, we will refund any prepaid subscription fees for the unused portion of your billing period on a pro-rata basis. If termination is due to a Terms violation, no refund will be issued.
We may update these Terms. For significant changes, we will notify active users by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance. If you do not agree with the changes, you may cancel your subscription and stop using the Service before the effective date.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be submitted to binding arbitration under the rules of a recognized arbitration body, except that either party may seek relief in a court of competent jurisdiction for intellectual property disputes or injunctive relief. Nothing in this section limits consumer rights that cannot be waived under applicable law in your jurisdiction.
